The area of family law is dynamic and constantly changing. Recent years have seen the introduction of the superannuation splitting provisions for married couples in the context of property settlement disputes, which have enabled the courts and family law practitioners to be more flexible with how they resolve disputes.

More recently, the Family Law Act has been amended to provide for the new parenting regime to take effect. In ordinary circumstances, the Act will apply certain presumptions in parenting disputes that significantly impact upon how parenting disputes will be resolved. There are now mandatory mediation requirements before a party can apply to the court for a parenting order.

For defacto couples, the law in relation to property settlement has traditionally been more difficult. However, a bill presently before Parliament will hopefully see defacto couples being able to bring their property dispute before the Family Court, which will make things easier and less expensive.

The child support regime has also changed significantly from 1 July 2008 and a new formula is to apply when determining the level of support to be provided by both parents.
