Public Liability

If you’ve had concerns about your health or safety while you were on someone else’s property or due to another’s negligence, contact us to find out your rights.

If you’ve suffered injury due to another’s negligence or carelessness and the injury was not incurred in a road or workplace accident, you could be eligible to claim personal injury compensation.

Claims for injury that are not related to road or workplace accidents include public liability, occupiers’ liability, professional negligence, product liability and medical negligence claims and are governed by the Personal Injuries Proceedings Act (PIPA). These types of personal injuries claims can be quite complicated. At Baker O’Brien Toll Lawyers we have an expert personal injury team who can guide you through the claims process. We offer a free initial consultation where our lawyers will assess your claim; explain your rights and what you can expect throughout the legal process.

Time Limits on Personal Injury Claims

Generally, in relation to accidents in Queensland you only have three years from the date of accident within which to issue proceedings in Court. Should you not issue proceedings within this time then you could lose your rights forever and be prevented from claiming.

What Is Personal Injury?

Personal injuries can occur at work, in public and sometimes even in your own home. The broad nature of personal injury claims means that each claim we receive will be treated differently, and may be covered by a variety of state laws. Injuries may include broken bones, repetitive strain injuries, collisions, post-traumatic stress and anxiety. To successfully claim compensation for your injury, you need to prove that you have suffered significant damages. This may be a loss of work, income or being out-of-pocket due to medical expenses.

What Can I Claim For Personal Injury?

Compensation under a personal injury claim can include:

  • Past and future medical expenses
  • Pain and suffering
  • Past and future economic loss
  • Care and assistance
  • Property damage
